The inside story

Lucknow, Sun Aug 14 2011: Fourteen-year-old Akbar’s appeal to the judge to let him remain with his Hindu guardian instead of transferring him to his Muslim mother has shot Aiku Lal Sandil to national headlines. However, for the tea vendor from Baradari, Lucknow, taking in Akbar wasn’t something he thought twice about. Having been raised by a Muslim man himself, Sandil couldn’t just look away when he found the six-year-old lost boy in a Lucknow park eight years ago.
“I am a Hindu brought up by a kind Muslim man. When I found Akbar, it was like God telling me that it is time to return the love and care I got from His people. I was never forced to change my religion and, having got that education from my guardian, it was my duty to take care of the child and bring him up as per his own religion,” Sandil says.
The bond the two share was acknowledged by the Allahabad High Court in January 2008 when it turned down Akbar’s biological mother Shahnaz Begum’s habeas corpus petition. Shahnaz had argued that since Akbar was a Muslim, if Sandil raised him, it would “create dichotomy and disharmony in the social sphere and in their relationship”.

Dismissing her petition, after Akbar said he wanted to live with Sandil rather than his parents, Justice Barkat Ali Zaidi said India is a secular country where the consideration of caste and creed should not be allowed to prevail. “...If there can be inter-caste marriages... there can also be an inter-caste ‘father and son’ relationship and that need not raise eyebrows,” the judge said.

Shahnaz has now moved the Supreme Court, and last week it asked her to file an affidavit on her monthly income, the property she owns and the school where her other two children study.

What the high court found strange was that Shahnaz approached it in 2007, four years after Akbar went missing, and that she had not even filed an FIR in the intervening period.

Akbar’s parents first stepped forward to claim their son after they saw Sandil on TV, recounting his story to mediapersons at a political party’s office in Qaiserbagh where he briefly worked. “They came to me... I did not know them. Later on, the district administration decided that since they had not lodged any FIR, Akbar would live with me,” says Sandil. Later, the parents moved the high court.

A six-year-old at the time he got lost, Akbar had gone to a liquor shop with his father in Allahabad, where they lived. While the father was busy buying liquor, he strayed away and somehow landed up in Lucknow.

It was Sandil’s neighbour Kushmavati Devi who first noticed Akbar on a cold winter evening in 2003, playing with her children in a park next to Baradari. “As the children returned home, he started crying. He said his name was Akbar and that his father had gone to bring food and also that he lived in Pan Dariba. Sandil was also here and I handed over Akbar to him,” remembers Kushmavati.

With five children of her own, Kushmavati has been a foster parent to the boy. It’s at her house that he drops in for most meals.

Sandil says when he found Akbar, he had liver problems, weak limbs and an infected foot which made it difficult for him to walk. “I took him to doctors; I also massaged his limbs with medicated ointments. Once he broke his hand and I carried him as far as Etaunja to get treatment,” say Kushmavati.

Sandil recounts how he himself was brought up by Chaudhary Mujtaba Hussain, who was a member of a governing body that looked after the well-known Baradari moument. “I have seen Aiku living with my father ever since I was a child,” says Chaudhary Hasan Imam, Hussain’s son.

Hussain taught Sandil how to read and write English, Hindi and Urdu, though he never went to school. Despite his meagre income, Sandil has ensure that doesn’t happen to Akbar. “Initially, Akbar was enrolled in Prathamic Vidhyalaya, Qaiser Bagh, Refugee Camp, and two years later, he was enrolled in Queens Inter College. Recently, I shifted him to Mumtaz Inter College, Aminabad, where the classes are more regular,” says Sandil. He also pays Rs 100 a month for a daily, one-hour tuition in a nearby area.
“My income is not much but I am doing all I can to educate Akbar. I hardly save Rs 500 per month,” says Sandil.

Every Friday, Sandil also ensures, Akbar goes to the masjid to offer namaaz. “Abhi namaaz yaad to nahin hai par main jumme ke jumme masjid jata zaroor hoon (Though I do not remember the prayers as of now, I definitely go to the masjid every Friday),” says Akbar.

If the Supreme Court directs that Akbar be given to his parents, Sandil says, he will abide. “But if it is against the will of Akbar, I will not leave the child crying with his mother.”

  3. sweety: This is true and touching examle of humanity where love and affection is greater than man made,caste,creed...religion etc...If all take lesson from sandil and his muslim gaurdian(who raised up sandil),then there would be no fights and harms in the name of religion atleast....I am so touhed by this story and wish that Akbar stays with his Hindu gaurdian and prove that humanity is not contrained by these nonsence/illogical social barriers .......

  4. I think sadil & child biological mother both should settle this matter out of court. lets not forget also the pain of mother who has given birth to akbar. I think both of the parties should try to find the middle path & try to accept each other presence in akbar's life.

  6. In respect to court's decision: the both party should compromise and keep the child together and give love and affection together,so that the child will accept all, the biological parents and the life giver man(his acceptable father).

  36. I am Indra Patel of Gujrat. There is no doubt India is a secular country and here all religion are living togather as a family. After watching this horrible episode and butcher judgement by the courts is very sad. These Basters seprated a child from his original parents and sisters. I wish all the people involved in this brutal judgement face the same situation and loose their children and when their child will find the court give the same decision and do not give their children to them and then they feel what is the feelings at that time. At that time you baster say humanity. Fuck you all Basrters and the courts Basters.

  37. WOW I am a Pakistani and a muslim too . I am proud of this man as he gave an honourable example of humanity. He taught the child Islam which id very good.so

I read all the comments but honestly comments by Mr Indra Patel caught my attention. It is very good for humanity, but is it humanity to seprate the child from his biological parents. The boy is a child has very limited thinking. I am thinking about his real parents. It is not a matter of religion involvement. It was avery simple case but we all are narrow minded idiots ver easily blackmail by using the name of religion. Thick if this situation happen any one of us how disheartening it would be.

    ReplyDelete
  39. I agree with court decision as biological parent didnt really lost him cause of natural disaster or something... They lost him as his dad was to drunk to look after his own child....... Even if you give child to biological parents who says that they won't loose him again... Then what???.... Also child does have say in it..

  40. THE COURT TOOK THE RIGHT DECISION...........IT WAS A STEP TOWARDS IMPROVING HINDU MUSLIM RELATIONS....AND THE CHILD TOOK THE RIGHT DECISION OF STAYING WIYH HIS HINDU GUARDIAN.!!

BUT WE SHOULD NEVER FORGET THE MOTHER N HER PAIN....may things come out in everyone's favor N MAY PEACE PREVAIL...I think the address or bank account no should be provided... n EVEN IF 1/4TH OF THE INDIAN POPULATION WILL SHARE A RUPEE ..... D CHILD CAN BE GIVEN SUPERB EDUCATION......... so the child can take care of his father n biological mother in future...

  67. This is a very heart touching story. Thanks a lot to crime petrol for showing this story on TV. I am fully agree with the court decision about the child. Many many thanks to that person also who has raised Sandil to come up in his life when he was in a bad situation. That muslim guy has given a very good parvarish to sandil & making him understand the others situation. When some one has experienced such a bad situation then he will definitely help others......Very hatt's off to Sandil & Sandil's father(who has raised him). The main thing was that Akbar's biological parents has not even tried to lodge a single complaint n not even tried to find out. By mistake they had seen the news n that time they remembered their child. This is very unfair seriously......I think now also the case is going on in Supreme court.....no one can take Akbar away from Sandil......I have heard that Akbar's biological father has expired n it is so sad to hear. but now the best option is Sandil & Akbar's mother should get marry with each other so that they both can keep the child very happy. I think this is the only way to solve the problem....as we should understand a mothers feelings tooo.....

What ever happens happens with the will of Allaha, when Imran want to stay with his raising father whats wrong in that, rather coming after 5 years not even registering a sing complaning after loosing 3 year old son that too just because of pure negligence is shameful on the part of biological parents. Well done high court. Even if the court would have give custody to biological parents do u think that Emmu would have live happilly with them and we all know answer will be no no and No. So accept the will of All mighty Allaha. The raising hindu father was raised by a muslim family without forcing to change his religiion. When a muslim can do that y cant a hindu.Very good example of humanity Long live kisandas.

  121. I have gone through almost all the above comments. I fully agree with all of them. One suggestion which has been mentioned above - that now sandil & akbar's mother should get married - is also good. I have watched the episode. And to be very honest I like everything upto Akbar's original parents approach to Police Station after watching a news over TV.. !! But, after that the stand Sandil took that he would not like to return Akbar back to his original parents - WAS NOT APPROPRIATE, as I believe. Because, first question should be raised is (1) Didn't Sandil want to find out akbar's parents in the initial stage ??? Then why did he refused once they were in the police station ?? (2) Wasn't it revealed that Sandil wanted to fulfill his own obligation of the life through akbar's raising ?? Ok... it was also inappropriate that akbar's real parents must be highly oblized to Sandil for taking care of their son & they didnt do it. On the contrary they adversely behave with Sandil. But, Why Sandil couldnt understand that akbar's parents were real authorized to take back their child.

Now, you can see akbar's father got dead becasue of all this guilt feelings, etc. And now, akbar's mother has been suffering for no reason at all. Court has given this judgement to prove that India is secular. But, nobody has put a thought on few real hard truth of the complete episodes, e.g. Sandil's ultimate objective of keeping akbar with him, the immense pain of akbar's mother for loosing her own child, akbar's father's guilt of missing him in the childhood due to alkohole....!!!

if someone read this ... kindly revert back if it does contain some sense.

  124. I normally do not watch other entertaining channels of TV except sports & news. Due to insisting of my wife ( she is teacher) in the recent days I have been watching Crime Patrol. Really many lessons can be learnt from the presentation. Sri Sony's prowess by summing up is sublime. The episode Hindu man nurtures a Muslim child is wonderful & in my personal view best among the episodes. All the rational human being will be happy to observe such incident. It has only proved love to human being is sine qua non not religion. Love & affection(Akbar/ Imran) has been getting from a Hindu person is no way less than their parents & that is why he is more keen to stay with Sri Aku Lal/ Kishen Das. India is beautiful country,as quoted by many foreigners to me while I was in abroad (many countries) "Your country is incredible, interesting, no comparison with others". Yes no doubt our country is beautiful - so many religious communities, social , cultural diversities etc., cannot be found in any country of the world. However this episode is a great one a lesson to hard core fundamentalists and few others who always try to take the benefit by dividing people. Let us all join to make our country a prosperous one. More we are divided and fighting, foreigners will take the advantage by selling arms & ammunition. And then behind the curtain these foreigners will ridicule us. It is known to all Indians, Pakistanis & Bangladeshis that after Sepoy Revolution in 1857 The British desperately tried to rule & exploit us by dividing in the name of religion & same British could not stay in Eritrea (African country) even for 10 years as they did not find any charm to rule the country.

  125. Friends,
I have also watched the episode and would say that Crime Patrol and its team are doing a Great Job. Its not only about the story which they have shown but also the way it has been presented. 'Hats Off' to the Director, Mr Anoop Soni and the actors. A Special Mention about the person who played the Character of Kishenji, "Man you Rocked". I also saw you playing the role of Crime Branch Police Officer in one of the previous episode (Bhopal Cantonment) and believe me you were equally convincing then also. But in character 'KISHENJI' you were GREAT. If anyone can share his name I would like to know more about him.
Talking about the incident, I would like to share that Once Again I felt Proud to be an Indian. Its great that we still have people like Sandil amongst us who value Humanity above anything else. In spite of all odds he did what his heart said. In fact the credit goes to Chaudhary Mujtaba Hussain who imbibed these values in Sandil. Full Marks also to Justice Barkat Ali Zaidi who valued 'Secularism in India' and ensured that caste and creed should not be allowed to influence justice.
One of the best TV episode in recent times. I am a father myself and could feel the Bond existing between Father and Son while watching the episode. I wish Sony TV and CP Team All The Best.

"MAN lives by love only".. its doesnt matter whether the love is provided by the parents or some stranger!! Jay hind...

  142. One of the comments made here by one Indra Patel of Gujarat vividly reveal 'saitan' type of persons still exit in our country. In Ramayana & Mahabharata many stories are there where 'Muni -Rishis' havan ( fire worship) were scuttled by the saitans. Sri Patel is not rational human being so he is uttering non-sense. No Indians will take you positively. My suggestion to you have good value & culture read more Ramayana & Mahabharata with positive mind. Love human being & please don't abuse others.
